for WatchDuck

These Terms of Service govern your access to and use of the WatchDuck website, waitlist, and any current or future products, dashboards, APIs, automations, integrations, or related services we provide.
By accessing or using WatchDuck, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the website or services.
1. Eligibility and Acceptance
You may use WatchDuck only if you are legally able to enter into a binding agreement on your own behalf or on behalf of the person or organization you represent. If you use the service for a company or client, you represent that you have authority to bind that party to these terms.
2. Services Covered by These Terms
These terms apply to our public website, waitlist flows, email communications, hosted applications, analytics features, AI-powered monitoring outputs, and any paid or unpaid services we make available now or later.
Features may change over time. We may add, remove, suspend, or modify functionality at any time, including during testing, private beta, or general availability.
3. Accounts and Access
Some parts of WatchDuck may require you to create an account or provide contact details. You agree to provide accurate and current information and to keep your login credentials secure.
You are responsible for activity that occurs under your account or through your access, including actions taken by teammates, contractors, or other users you authorize.
4. Acceptable Use
You agree not to misuse WatchDuck. In particular, you may not:
- use the service in violation of applicable law, regulation, or third-party rights;
- attempt to gain unauthorized access to systems, data, accounts, or infrastructure;
- interfere with the service through bots, scraping, abuse, spam, or denial-of-service activity;
- reverse engineer, copy, resell, or create competing services from protected parts of the product;
- submit unlawful, infringing, defamatory, or harmful content through the service;
- use outputs from the service in a way that violates platform terms or source-site restrictions.
5. User Content and Inputs
You retain responsibility for the prompts, keywords, account connections, uploaded data, text, and other materials you submit to WatchDuck. You represent that you have the rights needed to provide that material and to authorize us to process it for the purpose of operating the service.
You grant us a limited right to host, process, transmit, and use your inputs and related data solely to provide, maintain, secure, improve, and support WatchDuck.
6. Monitoring Data and AI Outputs
WatchDuck may collect and display information from public or authorized third-party sources and may generate summaries, alerts, classifications, sentiment labels, or other AI-assisted outputs. Those outputs may be incomplete, delayed, approximate, or incorrect.
You are responsible for reviewing results before relying on them for business, legal, reputational, or operational decisions. We do not guarantee that all relevant mentions, events, or signals will be found or correctly interpreted.
7. Fees, Trials, and Billing
If we offer paid plans, pricing, billing cycles, trial access, feature limits, and payment terms will be described on the website, in-product, or in a separate order or subscription flow. Unless stated otherwise, fees are non-refundable once a billing period begins.
If you provide a payment method for a recurring plan, you authorize recurring charges for the applicable subscription until you cancel in accordance with the cancellation terms then in effect.
8. Third-Party Services
WatchDuck may rely on or integrate with third-party providers, including social platforms, analytics services, infrastructure vendors, payment processors, and AI model providers. Your use of those third-party services may be subject to their separate terms and policies.
We are not responsible for third-party services, third-party content, or changes those providers make to their APIs, data access rules, pricing, or availability.
9. Intellectual Property
WatchDuck and its design, software, branding, site content, and service functionality are protected by intellectual property laws. Except for the limited rights expressly granted in these terms, we reserve all rights in and to the service.
You may not copy, reproduce, distribute, modify, or create derivative works from protected parts of WatchDuck except as expressly permitted by us in writing.
10. Feedback
If you send us suggestions, ideas, product feedback, or feature requests, we may use them without restriction or compensation to you. We are not obligated to treat feedback as confidential.
11. Suspension and Termination
We may suspend or terminate access to WatchDuck, with or without notice, if we reasonably believe you violated these terms, created risk for us or others, used the service in an abusive manner, or if continued operation is no longer commercially or technically feasible.
You may stop using the service at any time. If you are on a paid plan, cancellation will apply according to the billing terms then in effect.
12. Disclaimers
WatchDuck is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
We do not warrant that the service will be uninterrupted, error-free, secure, or suitable for any particular use case.
13. Limitation of Liability
To the maximum extent permitted by law, WatchDuck will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising from or related to your use of the website or services.
To the maximum extent permitted by law, our total liability for any claim related to the service will not exceed the greater of the amount you paid us for the service during the 12 months before the claim arose or fifty U.S. dollars (US$50).
14. Indemnification
You agree to indemnify and hold harmless WatchDuck from claims, damages, liabilities, costs, and expenses, including reasonable legal fees, arising out of your use of the service, your content, your violation of these terms, or your violation of applicable law or third-party rights.
15. Governing Law and Disputes
These terms are governed by applicable law determined by the location from which WatchDuck operates the relevant service relationship, unless a different governing law is required by mandatory consumer protection rules. Before starting formal proceedings, you agree to first contact us at [email protected] and try to resolve the dispute informally.
If informal resolution does not work, disputes will be handled in the forum and manner permitted by the applicable agreement and governing law in effect at that time. If you want a mandatory arbitration clause or a more jurisdiction-specific version later, that should be added with legal review rather than guessed here.
16. Changes to These Terms
We may update these Terms of Service from time to time. If we make material changes, we will update the “Last updated” date on this page and may provide additional notice where appropriate. Continued use of WatchDuck after the updated terms take effect means you accept the revised terms.
